Résumé : | Abordé par diverses disciplines relevant des sciences sociales, le patrimoine culturel immatériel, notion aux contours flous à l instar de la notion de patrimoine, l est encore aujourd hui assez peu au prisme du droit. L adoption de la Convention pour la sauvegarde du patrimoine culturel immatériel en 2003 par l UNESCO représente un changement de paradigme en matière de patrimoine culturel. Fondée sur le respect des communautés, elle nécessite une approche renouvelée de la sauvegarde des pratiques culturelles traditionnelles. L évolution du droit international de la culture vers la promotion et la sauvegarde de la diversité culturelle entraîne l émergence d un droit du patrimoine culturel immatériel. Ce changement radical d approche apporte un éclairage nouveau sur la manière dont le droit français doit appréhender le patrimoine culturel immatériel, interrogeant dès lors celui-ci, fondé exclusivement sur une logique matérielle, économique et propriétariste du patrimoine.L objet de cette recherche se propose de réfléchir à la manière dont le droit français saisit la notion de patrimoine culturel immatériel, ainsi qu à l influence exercée par la Convention pour la sauvegarde du patrimoine culturel immatériel sur celui-ci, permettant de révéler les potentialités et les obstacles à une prise en compte effective du patrimoine culturel immatériel en droit français. Identifier et interroger les moyens employés par ce dernier pour sauvegarder et promouvoir le patrimoine culturel immatériel révèlent que si certains outils et principes du droit français répondent aux enjeux de sauvegarde du patrimoine culturel immatériel, cette notion incite néanmoins celui-ci à innover. Addressed by various social sciences disciplines, intangible cultural heritage, a notion as vague as that of heritage, is still relatively undefined in legal terms. The adoption of the Convention for the Safeguarding of the Intangible Cultural Heritage in 2003 by UNESCO represents a paradigm shift in the field of cultural heritage. Based on respect for communities, it calls for a renewed approach to safeguarding traditional cultural practices. The evolution of international cultural law towards the promotion and safeguarding of cultural diversity is leading to the emergence of an intangible cultural heritage law. This radical change of approach sheds new light on the way French law should comprehend intangible cultural heritage, thus calling into question the present law, which is based exclusively on a material, economic and "proprietary" logic of heritage.The purpose of this research is to reflect on the way in which French law grasps the notion of intangible cultural heritage, as well as the influence exerted by the Convention for the Safeguarding of the Intangible Cultural Heritage on it, thus revealing the possibilities and constraints of an effective consideration of intangible cultural heritage in French law. Identifying and examining the means employed by the latter to safeguard and promote intangible cultural heritage reveals that while certain mechanisms and principles of French law meet the challenges of safeguarding intangible cultural heritage, this notion nevertheless encourages it to break new ground. |
