Mme Alegria Borrás, professeur ordinaire de droit international privé à la Faculté de droit de Cordoue, à l Université autonome de Barcelone et à l Université de Barcelone, procède à une étude approfondie de cette nouvelle réalité. Le professeur Borrás aborde dans une première partie la question du droit communautaire et des rapports privés internationaux sous deux aspects : d une part sous celui de l évolution des objectifs du droit communautaire (de la création d un marché intérieur à l apparition de la citoyenneté européenne et à la création de l espace judiciaire européen) par rapport au droit international privé, et d autre part sous celui de l incidence du droit communautaire sur les rapports privés internationaux du fait de l application de techniques spécifiques au droit communautaire (exercice des libertés communautaires, principe de non discrimination en raison de la nationalité) et de techniques de droit international privé adaptées aux objectifs communautaires (rapprochement des législations, principe de reconnaissance mutuelle). La deuxième partie du cours du professeur Borrás porte sur la communautarisation du droit international privé et ses effets. Mme Borrás examine les effets de la communautarisation du droit international privé sur les États (avant et après l entrée en vigueur du traité d Amsterdam) et les effets de cette communautarisation par rapport aux États tiers, qui doivent se préoccuper de savoir si la compétence appartient à la Communauté ou aux États membres. | ||

Mrs Alegria Borrás, Professor of private international law at the faculties of law in Cordoba, the Autonomous University of Barcelona and the University of Barcelona, develops the subject by sharing her in-depth examination of this new reality. In the first part, Professor Borrás looks at the question of community law and private international relations from two angles: from the perspective of the evolution of the objectives of community law (from the creation of an internal market to the appearance of a European citizenship and the creation of an European judicial area) in relation to private international law, and from the perspective of the impact of community law on private international relations because of the application of techniques that are specific to community law (applying the four Community Freedoms, the principle of non-discrimination on grounds of nationality) and techniques of private international law tailored to the community objectives (approximation of laws, the principle of mutual recognition). The second part of Professor Borrás' course concerns the communitisation of private international law and its effects. Mrs Borrás examines the effects of the communitisation of private international law on the member States (before and after the Treaty of Amsterdam came into force) and the effects of this communitisation with respect to third countries, that must be concerned about whether the jurisdiction belongs to the community or Member States. | ||
