Pour ce faire, Mme Reed décrit dans le détail trois cas de solutions mixtes : l Iran-US Claims Tribunal de La haye, la Commission de compensation des Nations Unies à Genève, et la Korean Peninsula Energy Development Organization (KEDO) à New-York. Les informations que fournit Mme Reed sur ces trois cas sont de première main, puisqu elle a travaillé dans le cadre de ces trois organisations. Pour chacun de ces trois exemples, Mme Reed présente l histoire de la crise diplomatique, la conception de la solution mixte droit public-droit privé. Mme Reed accorde ici une attention particulière à la négociation et au contenu des documents constitutifs ainsi qu à la pratique de chaque modèle et des résultats obtenus. Mrs. Reed provides us with first-hand information on these cases, since she participated in all three of them. For each one of them, Mrs Reed gives us the history of the diplomatic crisis and the customization of the mixed private/public international law solution. Mrs. Reed focuses on the negotiation and substance of the constituent documents, and on the process in practice and the outcome of each model. Mrs. Reed states in her introduction that the premise that there is a distinction between public international law and private international law is now for a large part anachronistic, and that experts coming from the world of private international law will find themselves confronted with the realities of public international law and vice-versa. |
