Dans un premier temps, le professeur Jänteä-Jareborg présente diverses théories, anciennes et nouvelles, concernant l application du droit étranger par les juridictions nationales : théories du Comitas Gentium, système de conflits de lois de Von Savigny, positions suédoises, américaines et de l Union européenne. Le professeur Jänteä-Jareborg s intéresse ensuite à la question de l invocation et de la preuve du droit étranger lors de la procédure, en insistant sur la division du travail entre la juridiction et les parties. Le professeur Jänteä-Jareborg s intéresse ensuite aux problèmes rencontrés au moment de l application du droit étranger, en particulier en ce qui concerne l accès au droit étranger et sa bonne application , les méthodes de preuve, et la solution adoptée lorsque la loi étrangère ne peut être prouvée. Mme Jänteä-Jareborg consacre les développements suivants au rôle de l autonomie de la volonté des parties, qui joue un rôle central en droit des contrats, mais pas uniquement. Le dernier chapitre du cour du professeur Jänteä-Jareborg est consacré à l unification des règles de conflits de lois en tant que méthode d intégration. Une attention particulière est accordée au droit de l Union européenne, et notamment à l impact du traité d Amsterdam. 
330 |a In this course on comparative private international law, Professor Maarit Jänteä-Jareborg of the University of Uppsala tackles the question of the application of foreign law in national courts. In the first part of the course, Professor Jänteä-Jareborg presents various old and new theories concerning the application of foreign law in national courts: the principle of Comitas Gentium, the system of conflicts of law by Von Savigny, and the positions taken by the US, Sweden and the European Union. Professor Jänteä-Jareborg then examines the question of pleading and proof in foreign law procedures, with a focus on the division of labour between the courts and the parties to the dispute. In what follows the problems encountered in the application of foreign law are discussed, in particular concerning access to sources of foreign law and its correct application, methods of ascertaining proof, and the solution to adopt in case of failure to prove foreign law. Mrs. Jänteä-Jareborg devotes the next section to the role of party autonomy, which plays a central role in contract law, but restrictions might apply. The final chapter is devoted to unified rules on choice of law as a method of integration. Special attention is given to the European Union, and in particular to the impact of the Treaty of Amsterdam.
