L auteur se penche ensuite sur ce que prévoit la Charte des Nations Unies en matière d admission et d exclusion des États, et sur le principe d intégrité territoriale des États selon cette charte (avec une mention spéciale pour la règle de l uti possidetis en tant qu élément de la succession d État). Le professeur McWhinney s intéresse ensuite au fédéralisme et au pluralisme constitutionnel en tant que possibilités d autodétermination dans les États multiethniques. Enfin, le Professeur McWhinney propose une nouvelle manière de penser la reconnaissance et la succession d États. | ||

The question of the self-determination of peoples is often resolved within the framework of the nation-state. But what if the State is a plural-ethnic State? Professor McWhinney first examines peoples' self-determination as a United Nations Charter principle. He then reports on the emergence of States in classical international law, paying particular attention to the recognition of the States. The author then focuses on the provisions in the United Nation Charter on the admission and the exclusion of States, and on the principle of territorial integrity of States (with a special mention of the uti possidetis doctrine as element in State succession). Professor McWhinney then studies federalism and constitutional pluralism as self-determination options for plural-ethnic States. In conclusion, Professor McWhinney proposes a new way of thinking about recognition and State succession. | ||
