Le professeur Mendelson commence par un chapitre introductif dans lequel il expose, notamment, les outils et concepts de base (sources du droit, coutume, etc.). Il décrit ensuite les éléments objectifs du droit international coutumier, puis ses éléments subjectifs. Le Professeur Mendelson consacre les développements suivants à la contribution des traités à la formation et à la détermination des règles coutumières. Enfin, le Professeur Mendelson s interroge sur l existence de nouveaux moyens de création des règles coutumières. Maurice Mendelson, professor at University College, London, insists in his course on the formation of customary international law on the fact that when we think of customary law-making in the international community, we should be thinking less of the modern legal process than of the customary domestic societies which existed everywhere in the past, but survive today for the most part only through the tolerance of the State. Professor Mendelson starts his course with an introductory chapter in which he presents the basic tools and concepts of customary international law (sources, custom, etc). He then goes on to describe first the objective element in customary international law, and then the subjective elements. Professor Mendelson dedicates the next chapter to the contribution of treaties to the formation and determination of rules of customary law. Finally, Professor Mendelson raises the question of the existence of new means of creating customary international law. |
