| Résumé : | Le professeur Conçado Trindade, juge et ancien président de la Cour interaméricaine des droits de l homme, fait le constat de ce qu en raison de développement considérable de la matière au cours des dernières décennies, il est impossible d en faire un compte-rendu approfondi. Il est donc nécessaire d opérer une sélection, qui se traduit par une présentation de la situation actuelle du droit international public en fonction d un leitmotiv. Le professeur Conçado Trindade propose donc de présenter la vision qu il a développée du droit international public après trente années de confrontation avec la théorie et la pratique de cette matière : la vision universaliste d un corpus juris de plus en plus orienté vers la satisfaction des besoins et des aspiration s des êtres humains, des peuples, et de l humanité tout entière. Dans cette optique, le professeur Cançado Trindade n entend pas se limiter au seul droit positif, alors que la discipline doit faire face à des tentatives malencontreuses de déconstruction sur le plan éthique et sur le plan pratique, qui traduisent en réalité la profonde crise de valeurs dans laquelle le début de XXIème siècle a sombré. Les thèses fondamentales développées par le professeur Cançado Trindade sont d une part que les individus la personne humaine sont, avec les États et les organisations internationales, sujets de droit international, et d autre part, que les conditions sont réunies pour que l on puisse entamer la construction d un nouveau jus gentium qui permette en ce début de XXIème siècle de prendre en compte les besoins sociaux et les aspirations de la communauté internationale (civitas maxima gentium), de l humanité dans son ensemble. Le professeur Cançado Trindade aborde successivement dans son cours les questions des fondements du droit international public, de sa formation, des sujets de droit international (notamment les individus et l humanité), et de la construction d un droit international de l humanité. Sont abordées dans le volume suivant (vol. 317) la question de l humanisation du droit international, celle du règlement des différends, et les perspectives ouvertes par l advenue d un nouveau jus gentium. Professor Conçado Trindade, judge and former president of the Inter-American Court of Human Rights, observes that, given the extraordinary expansion of the discipline along the last decades, it would be an impossible task to attempt to provide an in-depth and detailed treatment of international law. Thus, an element of selection is indeed necessary, and the author intends to provide an overall vision of the present state and perspectives of international law on the basis of a Leitmotiv. On the basis of his own experience in the handling of the theory and practice of international law throughout more than three decades, Professor Conçado Trindade thus presents his universalist vision of a corpus juris increasingly oriented to the fulfilment of the needs and aspirations of human beings, of peoples and of humankind as a whole. In the pursuance of this Leitmotiv, Professor Cançado Trindade sees no reason whatsoever to limit himself to positive international law, in face of unfortunate attempts of its deconstruction in theory and practice, which reflect the deep crisis of values in which the world seems engulfed at this beginning of the twenty-first century. Professor Cançado Trindade's fundamental contentions are that, besides States and international organizations, individuals also the human person are true subjects of international law, and that the conditions are set for us to move towards the construction of a new jus gentium, that will allow at this beginning of the twenty-first century to take into account the social needs and aspirations of the international community (civitas maxima gentium), of humankind as a whole. Professor Cançado Trindade addresses the question of the foundations of international law, its formation, the subjects of international law (in particular individuals and humankind), and the construction of the international law for humankind. The author addresses the humanization of international law, the settlement of disputes and the perspective of a new jus gentium in the next volume (Vol. 317). |
