| Résumé : | Le professeur Daudet, de l Université Paris I (Panthéon-Sorbonne), consacre principalement ce cours à la procédure de codification du droit international et aux transformations dont elle est l objet ou qu on pourrait lui apporter. Expliquant qu au-delà de la variété des codifications, des constantes se retrouvent partout et toujours dans la quête d une rationalité de la règle juridique voulue plus stable, plus protectrice et plus performante, le professeur Daudet développe son propos en trois temps. Il s intéresse tout d abord aux différentes formes de codification : codification en droit interne (codifications anciennes et modernes et notamment, en ce qui concerne ces dernières, codifications dans les systèmes de Common Law et dans les systèmes romano-germaniques) et en droit international. Le professeur Daudet aborde ensuite la question des objectifs de la codification du droit international. Il en présente les éléments organiques (structuration de la société internationale et idée de paix par le droit , codification comme instrument de cohésion de la société internationale, nécessité d une politique de codification) et les éléments matériels (la codification comme règle de droit ; la codification renforce la règle de droit ; la codification facilite l expansion de la règle de droit). Dans un troisième temps, le professeur Daudet s attache à rendre compte de la réalisation de la codification du droit international, en décrivant les organes de codification (la Commission du droit international et autres organes), l opération de codification (dimension technique et dimension politique de la codification), avant de dresser un bilan de la codification du droit international, à la fois d un point de vue organique et d un point de vue matériel. Professor Daudet of the University of Paris I (Panthéon-Sorbonne) devotes his course mainly to the codification process of international law and to its transformation and future developments. Explaining that beyond the variety of codification permanent features can be found, and always in search of rationality that wants a more stable, protective and efficient legal rule, Professor Daudet develops his subject matter in three parts. He first of all examines the various forms of codification: domestic law codification (old and modern codification and in particular, with regard to the last, codification of Common Law systems and Romano-Germanic law) and codification of international law. Professor Daudet then tackles the question of the objectives of the codification of international law. He presents the organic elements (the structuring of the international society and the idea of "la paix par le droit", codification as instrument of international cohesion, the need for a codification policy) and the material elements (codification as a legal standard; codification that reinforces the legal standard, codification that facilitates the expansion of a legal standard). In the third part of his course, Professor Daudet endeavours to give an account of the realization of international law codification, by describing the codification institutions (the International Law Commission and other institutions), the process of codification (the technical and political dimensions of codification), before drawing up an assessment of international law codification, both from an organic point of view and a material point of view. |
