L ordre juridique international, souligne en effet le Professeur Dupuy, est soumis à un phénomène constant d expansion qui consiste à la fois en une extension de son champ d application et en une complexification des techniques de sa mise en oeuvre. Cette expansion crée un problème nouveau, celui du maintien de l unité, perçue à la fois du point de vue formel et du point de vue matériel, de l ordre juridique international. Ce phénomène impose un réexamen d ensemble. C est ce à quoi s astreint le professeur Dupuy, en abordant tout d abord la notion d ordre juridique, puis, dans un deuxième temps qui constitue le coeur de ce cours, en se penchant sur ce qui fait l unité formelle et l unité matérielle de l ordre juridique international. Le professeur Dupuy s attache ensuite à réexaminer l évolution de l ordre juridique international engendrée par la combinaison et les contradictions de la recherche de l'unité formelle et de l'affirmation encore hésitante d'une unité substantielle de l'ordre juridique international. Professor Pierre-Marie Dupuy, of the European University Institute of Florence, reminds us in the introduction to his general course on public international law about the unity of the international legal system and how relevant this topic is today. Indeed, as Professor Dupuy stresses, the international legal system is subject to a constant phenomenon of expansion which results on the one hand in an extension of its field of application, and on the other in an increased complexity concerning the techniques of its implementation. This expansion creates a new problem, that of maintaining unity, both from a formal and a substantive point of view. This phenomenon necessitates an overall re-examination. This is exactly what Professor Dupuy does, first of all by studying the concept of legal system, and then, in the core of this course, by examining the two principles of unity in the international legal system, one formal, and the other substantial. Professor Dupuy then re-examines the evolution of the international legal system, brought about by the combination and contradictions of the search for formal unity and the still hesitant assertion of a substantial unity of the international legal system. |
