Le deuxième chapitre est consacré à l établissement des règles concernant l arbitrage, avec des mentions particulières concernant la situation aux États-Unis, en Allemagne et dans les conventions de Bruxelles et de Lugano, et dans la directive de Bruxelles. Le troisième chapitre est consacré à l émergence de la théorie de l arbitrage aux Etats-Unis et en Allemagne. Le Professeur von Mehren aborde dans la deuxième partie de son cours les principaux thèmes relatifs à l arbitrage, tels le principe actor sequitur forum rei, le consentement et l instance arbitrale, le forum shopping et le fine tuning . La troisième partie du cours général de droit international privé du Professeur von Mehren constitue un épilogue dans lequel l'auteur traite de la convergence et du compromis en droit international privé, et, dans ce cadre, du rôle des instruments internationaux. | ||

The first part of Professor von Mehren's course is dedicated to the foundations and the emergence of jurisdictional theory. In the first chapter the reasons for exercising adjudicatory authority and its principal types are presented. The second chapter explores the design of jurisdictional provisions and mentions in particular the situation in the United States, in Germany, the Brussels and Lugano Conventions, and the Brussels Regulation. The third chapter is devoted to the emergence of the jurisdictional theory in the United States and in Germany. In the second part of his course, Professor von Mehren examines the principal themes relating to adjudicatory authority, such as actor sequitur forum rei, consent and adjudicatory authority, forum shopping and fine tuning. The last part of this course takes the form of an epilogue in which the author discusses convergence and compromise in private international law, and the role of international instruments in this field. | ||
