| Résumé : | Julio Barboza, Professeur à l Université catholique de Buenos-Aires, traite dans son cours des principales infractions que connaît le droit pénal international et les suit depuis les procès de Nuremberg jusqu à leur formulation dans le statut de la Cour pénale internationale. Le Professeur Barboza consacre une introduction succincte aux concepts fondamentaux et à l histoire du droit pénal international. Il s intéresse ensuite aux principales évolutions des infractions pénales depuis les procès de Nuremberg ainsi qu à la notion de responsabilité pénale en droit international. Le Professeur Barboza consacre les développements ultérieurs à la responsabilité pénale des individus et de l État. Son objectif est ici d exposer la structure interne de l imputation des infractions pénales internationales. Il décrit également les débats concernant les infractions commises par les États, en prenant en compte les développements survenus dans les travaux de la Commission du droit international. Enfin, l auteur procède à une description approfondie des tribunaux internationaux : le Tribunal de Nuremberg et les tribunaux ad hoc du Conseil de sécurité dans un premier temps, et de la Cour pénale internationale dans un second temps. In his course, Julio Barboza, Professor at the Catholic University of Buenos Aires, intends to deal with the principal infringements on international criminal law and to follow them from the Nuremberg trials to their formulation in the Statute of a Permanent Criminal Court. Professeur Barboza starts by a very succinct introduction to the fundamental concepts of international criminal law and by tracing a short history of it. He then examines the general lines of the evolution of the criminal offences starting with the Nuremberg trials, as well as the concept of criminal responsibility in international law. Chapter III deals with individual and State responsibility in criminal matters. His purpose is to expose the internal structure of attribution (imputation) of international crimes. He also considers the debated matter of State crimes, taking into consideration the present developments in the International Law Commission. In the last part of the course the author develops the subject of international tribunals: first the tribunals of Nuremberg and Tokyo and the ad hoc tribunals created by the Security Council, and finally, the International Permanent Criminal Court. |
