Le Professeur McClean se demande dans ce cours si dans la situation actuelle cette tradition commune existe toujours. Pour répondre à cette question, l auteur s intéresse successivement à l existence d un héritage commun, à la question du domicile, à différents aspects de l expérience du Commonwealth en matière de compétence et à la question de la rencontre du fédéralisme et du droit international privé. In his course of lectures, David McLean, Professor at the University or Sheffield, examines the private international law tradition of the countries that belong to the Commonwealth. The Commonwealth countries share the same legal tradition and stand in a particular stream of legal history: the Common Law tradition as it was developed in England. Professor McClean asks himself in this course if this common tradition still exist today. To reply to this question, the author highlights the following topics: the existence of a common heritage, the story of domicile, the different aspects of Commonwealth experience in jurisdiction, and the question of the meeting of federalism and Commonwealth private international law. |
