Michael Reisman, professeur à l Université Yale, à New Haven, a pour objet d identifier et d analyser une forme particulière de compétence assignée à la Cour internationale de justice : le contrôle judiciaire international des arbitrages internationaux. Dans le cadre de cette étude, le Professeur Reisman est particulièrement attentif aux problèmes politiques parfois épineux que rencontre la Cour internationale de justice dans l accomplissement de cette mission. Le premier chapitre est consacré à la compétence internationale et à l arbitrage, le deuxième au contrôle international dans la phase pré-arbitrale, le troisième au contrôle international au cours de la phase post-arbitrale, et le quatrième à l avenir de ce pouvoir de contrôle. This course of W. Michael Reisman, Professor at Yale University, New Haven, is concerned with the identification and analysis of a particular form of jurisdiction assigned to the International Court of Justice: the international judicial supervision of international arbitration. In the framework of this study Professor Reisman pays particular attention to the sometimes very thorny policy problems that the Court faces in carrying out this form of jurisdiction. The first chapter deals with the topics of adjudication and international arbitrage. In the second chapter the international supervision in the pre-arbitral phase is discussed, and in the third chapter the international supervision in the post-arbitral phase. In the last chapter the future of supervisory jurisdiction is examined. |
