| Résumé : | Dans ce cours consacré à l approche américaine du processus international de développement progressif du droit international privé, Peter Pfund, Assistant Legal Adviser au US Department of State, espère démystifier le processus international d unification/harmonisation du droit privé au niveau international. En attirant principalement l attention dans l ensemble de son étude sur le processus d harmonisation en tant que tel, Peter Pfund commence son cours par une introduction générale à l unification internationale du droit international privé. Il étudie ensuite comment les Etats-Unis préparent et participent aux réunions et conférences internationales, ratifient les conventions, et essaient de faire fonctionner les conventions relatives au droit international privé. Peter Pfund s intéresse ensuite au rôle des Etats-Unis dans les négociations intergouvernementales et au succès que rencontrent les conventions, lois types et règles qui en résultent, aux principaux projets en cours et à venir, et à l utilité de l unification/harmonisation du droit international privé. L auteur présente ensuite la Convention des Nations Unies sur les contrats de vente internationale de marchandises (1980) en tant qu exemple de processus international et de processus américain. Il analyse ensuite la Convention de La Haye sur l adoption internationale (1993) : problèmes rencontrés par les Etats-Unis lors des négociations, et questions qui doivent être résolues pour permettre une ratification. In this course devoted to the American approach of the international process of progressive development of private international law, Peter Pfund, Assistant Legal Adviser at the US Department of State, hopes to demystify the international process of unification/harmonization of "private" law at the international level. This study is primarily focused on the process of harmonization as such. Peter Pfund starts his course by a general introduction to the international unification of private international law. He explains in what follows how the United States prepares for and participates in international meetings and conferences, ratifies conventions, and seeks to make the conventions concerning private international law work. Peter Pfund then looks at the role of the United States in intergovernmental negotiations and the success of conventions, at the model laws and rules that are its results, at the major current and future projects, and at the usefulness of the unification/harmonization of private international law. The author then presents the 1980 United Nations Convention on contracts for the international sale of goods as an example of the international and United States domestic processes. Lastly, he analyses the 1993 Hague Intercounty Adoption Convention: problems confronting the United States in its negotiation, and issues that need to be resolved in order to ratify the convention. |
